Who Qualifies

 

Arrests only (I.C. 35-38-9-1)

  • 1 year from the date of arrest or charge

  • No charges currently pending

  • Arrest did not result in conviction

  • Not currently in a pretrial diversion program

 

Misdemeanor or Class D/Level 6 Felony that has been reduced to a Misdemeanor (I.C. 35-38-9-2)

  • 5 years from the date of the most recent conviction

  • No  charges currently pending

  • All fines, fees, court costs and restitution are paid

 

Class D/Level 6 Felony  (I.C. 35-38-9-3)

  • 8 years from the most recent date of conviction

  • Did not result in bodily injury

  • No charges currently pending

  • All fines, fees, court costs and restitution are paid

 

Less serious felonies (I.C. 35-38-9-4)

  • 8 years from the most recent date of conviction or three years completion of sentence (whichever is later)

  • Did not result in serious bodily injury

  • No charges currently pending

  • All fines, fees, court costs and restitution are paid

 

More serious felonies (I.C. 35-38-9-5)

  • 10 years from the most recent date of conviction or 5 years from completion of sentence (whichever is later)

  • No charges currently pending

  • All fines, fees, court costs and restitution are paid

  • Prosecutor consents to the expungement

How to get started
Our process for expunging your record is simple.  It is started by you filling out the form below.  We will search your criminal history and come up with a detailed plan and price for your specific circumstances. This will be done at no cost to you. If you decide you would like to move forward, then payment is made and we will get started on your case.  If your case falls under section 1 through 3, you most likely will not have to go to court or meet with us, everything will be handled online.  Once we have filed your petition and order with the court, we will send you a copy of the Judge's order expunging your record.  After filing your petition, there is normally a 30 to 60 day wait for your record to be expunged.
